Terms of Service

These terms govern your use of https://creativemexy.com.ng and any services provided by CreativeMexy. By accessing this site or engaging us for a project, you accept these terms.

1. Services

CreativeMexy provides web development, mobile app development, UI/UX design, and related software services. The specific scope, price and timeline for any project are agreed in writing before work begins.

2. Quotes and pricing

All quotes are provided in writing and are valid for 30 days from the date issued. A quoted price covers the scope described in the quote only. Changes to scope after work has started may affect the price and timeline, and will be agreed in writing before any additional work is carried out.

3. Payment

Payment terms are set out in the project agreement. Work typically requires a deposit before it begins, with the balance due on or before delivery. We reserve the right to pause or withhold delivery if agreed payments are not made.

4. Intellectual property

On receipt of final payment, ownership of the custom code and design assets we create for your project transfers to you. We retain the right to display the completed work in our portfolio unless you request otherwise in writing.

Any third-party libraries, fonts, stock assets or open-source components used in your project remain subject to their respective licences.

5. Client responsibilities

You are responsible for providing accurate content, timely feedback, and any materials (logos, images, copy) needed to complete the project. Delays caused by late client feedback may extend the agreed timeline.

You warrant that any content or materials you supply do not infringe third-party rights.

6. Warranties and liability

We build and test all work carefully. However, we cannot guarantee that software will be entirely free of defects or that it will work on every device, browser or configuration in existence.

Our liability for any claim arising from a project is limited to the amount you paid us for that project. We are not liable for indirect losses including lost revenue, data loss, or business disruption.

7. Maintenance and support

Unless a maintenance agreement is in place, we are not obligated to provide ongoing support after a project is delivered and paid for. We do offer maintenance packages and are happy to discuss ongoing support arrangements.

8. Confidentiality

We treat information you share with us about your business and projects as confidential. We will not disclose it to third parties without your consent, except where required by law.

9. Termination

Either party may terminate a project by giving written notice. If you terminate a project in progress, you are responsible for payment of all work completed to the date of termination. We will deliver all completed work and files upon receipt of that payment.

10. Governing law

These terms are governed by the laws of the Federal Republic of Nigeria. Any disputes will be resolved in the courts of the Federal Capital Territory, Abuja.

11. Changes to these terms

We may update these terms from time to time. The date at the top of this page shows when they were last revised. Continued use of the site constitutes acceptance of the current terms.
